Welcome to moodybeach.com ("Moody Beach", "we", "us"). By using this website you agree to these Terms of Service. If you do not agree, please do not use the site.

1. What Moody Beach is

Moody Beach is an independent local directory, community feed, and merchandise store serving Wells, Moody Beach, and Ogunquit, Maine. We publish listings, guides, and events submitted by homeowners, businesses, and community members, and we sell branded apparel and accessories.

2. Listing service — not a broker or booking agent

Vacation-rental and real-estate listings on Moody Beach are provided as a directory only. We are not a real estate broker, licensed rental agent, escrow service, or party to any transaction between hosts, buyers, sellers, or guests.

We do not verify the accuracy of listings, images, availability, pricing, permits, or licenses. We are not responsible for:

  • transactions completed on Airbnb, VRBO, or directly with a homeowner;
  • guest/host disputes, cancellations, no-shows, or refunds;
  • property damage, personal injury, or losses of any kind;
  • compliance with municipal short-term-rental permits or Maine state lodging tax obligations, which are the sole responsibility of the host.

3. Host responsibilities

Homeowners who publish a rental listing represent that they hold all required Town of Wells short-term-rental permits, that the property complies with local ordinances, and that they will collect and remit Maine state lodging tax as required. The paid listing fee does not constitute permission to operate a short-term rental.

4. Merchandise

Apparel and accessories are sold by Moody Beach and fulfilled through third-party print-on-demand partners. See our Refund Policy for returns and exchanges.

5. Accounts

You are responsible for keeping your account credentials confidential and for all activity under your account. Notify us immediately of any unauthorized use.

6. Prohibited use

Do not use Moody Beach to publish unlawful, misleading, harassing, or infringing content, to scrape data at scale, or to circumvent security controls.

7. Disclaimer of warranties

Moody Beach is provided "as is" without warranties of any kind, express or implied. To the fullest extent permitted by law, our total liability to you for any claim arising from your use of the site will not exceed the amounts you paid us in the twelve months before the claim.

8. Changes

We may update these Terms from time to time. Continued use of the site after changes are posted constitutes acceptance of the updated Terms.
